Welcome to siouxfallshomeservicepros.com (the “Platform” or “Website”). By accessing, using, submitting content to, or registering on our Platform, you (“User,” which includes general visitors, customers submitting quotes/reviews/sign-ups, and providers submitting/claiming listings) agree to these Terms and Conditions (“Terms”). Sioux Falls Home Service Pros (“We,” “Us,” “Company”) owns and operates this Platform—read carefully, as this is legally binding.

1. Acceptance and Eligibility

• You must be 18 or older and a South Dakota resident or business to use this Platform. By accessing or using it, you accept these Terms in full.

2. Permitted Use

• Use the Platform to browse, find pros, submit quotes, post reviews, sign up for services/newsletters, or list/claim business services—nothing else. Don’t scrape data, spam users, hack our system, or misuse features. Violations may result in bans or termination.

3. Intellectual Property

• All Platform content—text, design, logos—is ours. You can view it, but don’t copy, reproduce, or steal it without written consent.

4. User Content

• Content you post (e.g., reviews, quotes, listings, descriptions—“User Content”) remains yours, but you grant us a perpetual, royalty-free license to use, display, and promote it on the Platform. Keep it lawful—no defamation, threats, or junk. We may moderate or remove content at our discretion.

5. Privacy, Cookies, and Data Ownership

• We collect data per our Privacy Policy—name, phone, email, etc. We use cookies to track usage and improve service. By using the Platform, you consent to this. South Dakota’s SDCL 37-24-6 (deceptive practices) guides our transparency.
• Any data used on this site, including by Wattier Marketing, CRM blast lists, or client data shared with Sioux Falls Home Service Pros, becomes our property and may be used by us in our own mailing lists and in future marketing and promotions.

6. Submission and Registration

• Quote Submission: Provide accurate name, phone, email (optional), service needed, project details, location, and contact preference. Required fields must be completed.
• Review Registration: Register with name, email, and phone to post honest, lawful reviews—optional login available.
• User Sign-Up: Sign up via forms (e.g., newsletter) with accurate name, email, and phone (optional).
• Listing Submission/Claiming: Providers must be licensed/legitimate in our service areas; submit accurate details for Verified, Basic, or Premier listings. We may approve, reject, or remove any listing (submitted or unverified) at our discretion. Unclaimed listings (added by us) include basic details and may be removed if claimed or inaccurate.
• Accuracy: All info must be true and current—fake data voids your submission or account.

7. Lead Distribution and Ownership

• We own all leads (e.g., quotes, inquiries), including from unclaimed listings. Leads from paid listings (Verified, Basic, Premier) are exclusive based on tier: Verified (10 days), Basic (20 days), Premier (30 days). After exclusivity, unbooked leads are shopped to other tiers. Leads from unclaimed listings or without a preferred business are shopped immediately—Premier first, Basic after 24 hours, Free as available—regardless of preference or listing type. You may use leads only to service customers—reselling or sharing terminates your listing.

8. Commission Agreement (For Providers)

• Unclaimed Listings: No upfront fees or commissions. Leads are owned by us and added to the lead pool.
• Bronze Listings: $49.99 monthly fee; 10% commission + 5% off coupon on booked job value (excluding taxes), due within 15 days of contract.
• Silver Listings: $79.99 monthly fee; 8% commission + 5% off coupon on booked job value (excluding taxes), due within 15 days of contract.
• Gold Listings: $99.99 monthly fee; 5% commission + 5% off coupon on booked job value (excluding taxes), due within 15 days of contract.
• Payment: Invoiced via email; pay by check, bank transfer, or approved method. Late payments incur 1.5% monthly interest. Non-payment triggers $500 penalty per job (or 25% of value, whichever greater), plus costs—aligning with South Dakota breach remedies. Report booked jobs within 48 hours.

9. Tracked Phone Numbers and Consent to Contact

• We may provide tracked numbers to connect users with pros or track leads. Calls are recorded for quality/compliance—you consent to recording per South Dakota’s one-party consent law (SDCL 23A-35A-20).
• By submitting quotes, reviews, sign-ups, listings, or using tracked numbers, you consent to us contacting you by phone (including recorded messages), email, or text for follow-ups, newsletters, promotions, or updates. We use a CRM for these—opt-out via “unsubscribe” or texting “STOP.” This waives TCPA claims (47 U.S.C. § 227) for consented contacts, provided we honor opt-outs.

10. User Obligations

• Customers: Respond to pros; honor discounts (0-20%, set by us). Post fair reviews.
• Providers: Perform jobs professionally per South Dakota laws; honor discounts; report jobs within 48 hours.

11. No Guarantees

• We don’t perform jobs or guarantee responses, quality, availability, or outcomes—Platform is “as is.”

12. Third-Party Links

• Links to external sites (e.g., pro websites) aren’t our responsibility—use at your risk.

13. Liability Limits and Indemnity

• No warranties on accuracy/uptime. We’re not liable for damages (e.g., lost profits, data)—max liability is $100 per South Dakota’s UCC (SDCL 57A-2-719).
• You indemnify us against claims from your actions/services/breaches.

14. Termination

• We can block access, reject/cancel submissions, or terminate accounts/listings for breaches or at discretion—no notice needed. You can cancel with 30 days’ notice; commissions remain due.

15. Governing Law and Disputes

• South Dakota law governs (SDCL 53-1). Disputes go to arbitration in Sioux Falls (AAA rules), unless we seek injunctions in Minnehaha County courts. No class actions.

16. General
