Using siouxfallshomeservicepros.com (“Platform”) to submit a quote request, register to post a review, or sign up as a user means you (“Customer” or “User”) agree to these Terms and Conditions (“Terms”). Sioux Falls Home Service Pros (“We,” “Us,” “Company”) operates this service—here’s the deal.

1. Submission and Registration

  • Quote Submission: Use “Get a Quote” to provide your name, phone, email (optional), service needed, project details, location, and contact preference. Required fields must be completed.
  • Review Registration: To submit a review, register with your name, email, and phone—optional login creation available. Reviews must be honest and lawful.
  • User Sign-Up: Sign up via forms (e.g., newsletter opt-in) with your name, email, and phone (optional).
  • Accuracy: All info must be true and current—fake data voids your submission or account.

2. Lead Distribution and Ownership

  • Shopping Quotes: We shop your quote to all eligible businesses on the Platform, even if you name a specific pro. We own all leads—your request isn’t exclusive. Summit tiers get priority, Boost after 24 hours, Free as available.
  • Consent: Submitting a quote, review, or sign-up means we control lead distribution and may contact you to verify details.

3. Tracked Phone Numbers

  • Usage: We may provide tracked phone numbers on the Platform to connect you with pros or track leads. Calls via these numbers are recorded for quality and compliance—by using them, you consent to recording, per South Dakota’s one-party consent law (SDCL 23A-35A-20).

4. Consent to Contact via Lead Tools

  • Agreement: By using any lead tool—quote forms, review registration, sign-up forms, or tracked numbers—you consent to us contacting you by phone (including recorded messages), email, or text for service follow-ups, newsletters, promotions, or updates.
  • CRM Use: We use a CRM to send newsletters, email/text blasts, and recorded voice messages. You agree to this contact—opt-out available via “unsubscribe” links or texting “STOP.”
  • Legality: South Dakota follows federal TCPA rules (47 U.S.C. § 227)—your consent here waives claims against us for these contacts, as long as we honor opt-outs. You can’t sue for receiving consented communications.

5. Customer Obligations

  • Response: Respond to pros who contact you—ignoring them wastes time.
  • Discount: Jobs booked through us get a 0-20% discount—non-negotiable.
  • Reviews: Post fair, non-defamatory reviews—we may moderate or remove them if they violate laws or decency.

6. No Guarantee

  • Service: We don’t perform jobs—pros do. No promises on response time, quality, or pro availability.
  • Outcome: Submitting quotes, reviews, or sign-ups doesn’t guarantee service or publication—market and moderation apply.

7. Liability

  • Our Role: We’re a middleman—pro disputes are yours to handle. We’re not liable for damages, delays, or bad work—max liability is $50.
  • Indemnity: You cover our costs if your actions (e.g., false info, misuse) cause legal issues.
  • No Sue Clause: By consenting to contact (Section 4), you waive rights to sue us for communications you’ve agreed to, provided we follow opt-out requests.

8. Termination

  • We can reject, cancel, or suspend your quote, review, or account for any reason—e.g., spam, abuse—no notice required.

9. Governing Law and Disputes

  • South Dakota law applies (SDCL 53-1). Disputes go to arbitration in Sioux Falls (AAA rules)—courts for emergencies only. No class actions.

Terms and Conditions for Submitting a Listing

Submitting or claiming a listing on siouxfallshomeservicepros.com (“Platform”) means you (“Provider”) agree to these Terms and Conditions (“Terms”). Sioux Falls Home Service Pros (“We,” “Us,” “Company”) operates this Platform—this is a binding contract, so read carefully.

1. Listing Submission and Acceptance

  • Eligibility: You must be a licensed or legitimate home service provider in one of our service locations, to submit or claim a listing.
  • Submission: Submit accurate details (name, category, description) for Verified, Basic, or Premier listings—keep them current once claimed.
  • Approval: We may approve, reject, or remove any listing—submitted or unverified—at our sole discretion, with or without notice, to maintain Platform quality.

2. Commission Agreement

  • Unclaimed Listings: No upfront fees or commissions apply. These are free listings added by us for Sioux Falls businesses that haven’t claimed a listing.
  • Bronze Listings: A $49.99 monthly fee applies. If a lead from the Platform results in a booked job, you agree to pay us a 10% commission & 5% 0ff coupon on the job’s total value (excluding taxes), due within 15 days of the signed contract to perform work.
  • Silver Listings: An $79.99 monthly fee applies, plus a 8% commission & 5% 0ff coupon on the job’s total value (excluding taxes) for each booked lead, due within 15 days of the signed contract to perform work. Rates are detailed at signup, and you agree upon submission.
  • Gold Listings: A $99.99 monthly fee applies, plus a 5% commission & 5% 0ff coupon on the job’s total value (excluding taxes) for each booked lead, due within 15 days of the signed contract to perform work. Rates are detailed at signup, and you agree upon submission.
  • Payment Terms: Commissions are invoiced via email. You’ll pay by check, bank transfer, or approved method within 15 days. Late payments incur a 1.5% monthly interest fee.

3. Unclaimed Listings (Added by Us)

  • Definition: We may create Unclaimed Listings for Sioux Falls businesses that haven’t claimed a listing. These include basic details (e.g., name, category, description) and remain unclaimed unless a Provider verifies ownership.
  • Lead Pool: Leads from Unclaimed Listings are owned by us and added to the Platform’s lead pool, shopped to all eligible Providers—Premier first, Basic after 24 hours, Free as available—regardless of customer preference.
  • Commission: No commission applies to Unclaimed Listings unless claimed and upgraded to a paid tier.
  • Responsibilities: Providers booking these leads must honor the customer discount (0% to 20%, set by us per lead or coupon) and report the job within 48 hours, including value and contract date.
  • Removal: We may remove unclaimed listings if claimed or inaccurate, at our discretion.

4. Lead Ownership and Distribution

  • Ownership: We own all leads (e.g., quote requests, inquiries), including from Unclaimed Listings. You may use them only to service customers—reselling or sharing terminates your listing.
  • Distribution: Leads from a paid listing (Verified, Basic, Premier) are exclusive to that Provider based on tier: Verified (10 days), Basic (20 days), Premier (30 days). After exclusivity, unbooked leads are shopped to other tiers: Premier (5 days), Basic (5 days), Free (day 11 for Verified leads, day 21 for Basic leads, day 31 for Premier leads, or later). Leads from Unclaimed Listings or without a preferred business are shopped immediately—Premier first, Basic after 24 hours, Free as available—regardless of preference or listing type.

5. Non-Payment Penalties

  • Obligation: If you book a job from any lead and fail to pay the commission within 15 days, you’re in breach. We’ll notify you with a 10-day cure period.
  • Penalty: Non-payment triggers a $500 penalty per job or 25% of the job’s value (whichever is greater), plus 1.5% monthly interest and collection costs. This aligns with South Dakota breach remedies. You’ll cover our legal fees if we enforce it.
  • Termination: Non-payment may lead to listing suspension or removal.

6. Provider Responsibilities

  • Quality: Perform jobs with professional skill, per South Dakota laws and standards.
  • Discount: Honor the customer discount—0% to 20%, set by us per lead, tier, or coupon—funded by our commission pool or your tier, for all leads including unclaimed ones.
  • Reporting: Report booked jobs within 48 hours, including job value and contract date.

7. Intellectual Property

  • Your Content: You own submitted descriptions or photos but grant us a perpetual, non-exclusive license for promotion.
  • Our Rights: Platform content, including Unclaimed Listings and lead data, is ours—don’t copy or misuse it.
